1. Introduction

Welcome to BYVO ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website and services for booking Vehicle On-Road Tests (VORT) in South Australia. By accessing or using our services, you agree to be bound by these Terms.

2. Definitions

• "BYVO" refers to our booking platform and services.
• "VORT" means Vehicle On-Road Test.
• "Examiner" refers to the accredited VORT examiner conducting your test.
• "Service" means our online booking platform and related services.
• "You" or "User" refers to the individual using our services.

3. Use of Service

You must be at least 16 years old to use our services. By using our platform, you represent and warrant that:

• You have the legal capacity to enter into these Terms.
• All information you provide is accurate, current, and complete.
• You will maintain the security of your account credentials.
• You will not use the service for any unlawful purpose.

4. Booking Process

4.1 Booking Confirmation

When you make a booking through BYVO:

• Your booking is confirmed immediately upon successful payment.
• You will receive a confirmation email immediately after payment is processed.
• We reserve the right to cancel or modify bookings if necessary, in which case you will be notified and alternative arrangements will be made.

4.2 Pricing

Pricing for VORT tests and lessons varies based on:

• The selected examiner
• Whether you use the examiner's vehicle or your own vehicle
• Additional services selected (pre-VORT lessons, full-day lessons)

All prices are displayed in Australian Dollars (AUD) and are subject to change without notice. Final pricing will be confirmed at the time of booking.

4.3 Payment

Payment is required at the time of booking confirmation. We accept payment through our secure payment gateway. All payments are processed securely and in accordance with Australian payment regulations.

5. Cancellations and Refunds

5.1 No Refund Policy

BYVO does not offer refunds. Once payment has been made, all sales are final.

By proceeding with payment, you acknowledge and agree that:

• All payments are non-refundable once processed.
• You will not be entitled to a refund for any reason, including but not limited to:
  • Cancellation by you for any reason
  • Failure to attend your scheduled test (no-show)
  • Test failure or inability to complete the test
  • Changes to your circumstances

5.2 Rescheduling

While refunds are not available, you may be able to reschedule your booking subject to:

• Availability of alternative dates and times
• Any rescheduling fees that may apply
• Rescheduling requests must be made at least 48 hours before your scheduled test time

Please contact us as soon as possible if you need to reschedule your booking.

5.3 Cancellation by BYVO or Examiner

In the rare event that we or an examiner must cancel your booking:

• We will notify you as soon as possible.
• We will make every effort to reschedule your booking at no additional cost.
• If rescheduling is not possible, alternative arrangements will be made on a case-by-case basis.

6. Test Requirements

You are responsible for ensuring you meet all requirements for the VORT test, including:

• Holding a valid learner's permit
• Meeting minimum age requirements
• Completing required logbook hours (if applicable)
• Providing a roadworthy vehicle (if using your own vehicle)
• Bringing all required documentation on the day of the test

BYVO is not responsible if you fail to meet these requirements and are unable to take the test.

7. Examiner Services

BYVO acts as a booking platform connecting you with accredited VORT examiners. We are not responsible for:

• The conduct or performance of individual examiners
• Test outcomes or results
• Any disputes between you and the examiner

All examiners listed on our platform are fully accredited and approved by the relevant South Australian authorities.

8. Vehicle Requirements

8.1 Using Your Own Vehicle

If you choose to use your own vehicle:

• The vehicle must be roadworthy and registered
• You must have valid insurance
• The vehicle must meet all safety requirements
• You are responsible for any damage to the vehicle during the test

8.2 Using Examiner's Vehicle

If you choose to use the examiner's vehicle:

• Additional fees may apply
• You may be required to pay a security deposit
• You are responsible for any damage caused during the test

9. Limitation of Liability

To the maximum extent permitted by law:

• BYVO's liability is limited to the amount paid for the booking service
• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for test outcomes, examiner decisions, or test failures
• We are not liable for any delays, cancellations, or changes beyond our reasonable control

10. Privacy

Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy and the Australian Privacy Principles. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

11. Intellectual Property

All content on the BYVO website, including text, graphics, logos, and software, is the property of BYVO or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Prohibited Activities

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems to access the service without permission
• Impersonate any person or entity
• Harass, abuse, or harm examiners or other users

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice, for any reason including breach of these Terms.

15. Dispute Resolution

If you have a dispute with BYVO:

• Please contact us first to attempt to resolve the issue
• If we cannot resolve the dispute, you may contact the relevant consumer protection authority in South Australia
• These Terms are governed by the laws of South Australia, Australia
